AFPM files legal challenge to US biofuel mandate

NEW YORK, Feb 10 (Reuters) - The American Fuel & Petrochemical Manufacturers (AFPM) said on Wednesday it has filed a lawsuit challenging the US environment regulator's biofuels policy, the latest industry body to join a legal battle over the controversial program.

The organization, which represents oil companies, said the petition to the US Court of Appeals is targeting the Environmental Protection Agency's rulemaking around the Renewable Fuels Standards from 2014-2016.

“Despite the agency’s best efforts, certain aspects of the final RFS rule still run afoul of the Clean Air Act," AFPM President Chet Thompson said. 

"Among other things, EPA failed to provide obligated parties with requisite lead time and used flawed methodologies in establishing volume requirements," he added. "This rule further confirms that the RFS program is dysfunctional and that the only real solution is full repeal by Congress.”

Last month, biofuel and agriculture groups did the same, kicking off a widely-expected legal review of the policy.
